It seems like I am leaking transmission fluid, how can I tell if this is because it was overfilled or if something is failing?

According to my haynes manual there should be a thermostat right there.

It seems my headlight switch has 4 wires coming from it into the connector, but only one wire is attached to anything, could this be why my speedometer backlights arent working? (high beams, and blinkers work fine)

On the transaxle question it depends on where it is leaking... there is another plug that looks like the one in the picture but it is on the side of the transaxle (drivers side) . That is the fill plug to check for level remove that plug... if fluid comes running out it is overfull... if it doesnt then add gear oil until it just seeps out. It is leaking though as overfilling is very hard to do (youll see what I mean... ).. have the car as level as possible when checking. If its not leaking bad then topping it off occasionally is better than pulling the engine and tranny for a small leak...

Located that plug on the side, good thing as I was about to pull the bottom plug. I am still unsure about the thermostat not being there, is there anywhere else it could be? This engine is from brazil if that helps.

See my post in the "missing thermostat" post you started.

Regarding your other woes, perhaps the wiring you spotted is the problem. To be honest, I installed a complete harness kit (Wattson Streetworks) so it's not exactly stock so I can't say for sure w/o putting my eyes on it. For that I would consult, if not already, your manual of choice. There should be a wiring diagram. If not let us know. We can provide one for ya.
As for the leak, I agree. If it's just a seep, fill it up and let it go for now. I have a small seep from one of my axle seals, even have the new seals but I'm gonna fix that when worse weather hits. Although it's just a matter of pulling the axle opposed to what you would have to do.

Look in the Bentley manual. All VW electrical parts terminals are numbered. It makes it easy to hook up wires correctly. A harness removed from a junk Beetle supplies you with the correct color wiring.
